1. Definitions

In these Terms and Conditions:

  • "Service" refers to the rainforest glamping programs offered by Monsuniq, including accommodation, guided activities, meals, and transport.
  • "Guest" or "You" refers to the individual or party making a booking.
  • "We", "Us", or "Our" refers to Monsuniq.
  • "Booking" refers to a confirmed reservation for one of our glamping programs.
  • "Agreement" refers to these Terms and Conditions together with our Privacy Policy and any booking confirmation.

2. Acceptance of Terms

By making a booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not proceed with a booking. These terms constitute a legally binding agreement between you and Monsuniq.

3. Booking and Payment

3.1 Booking Process

Bookings can be made through our website contact form, email, or phone. A booking is confirmed only upon receipt of a 50% deposit and our written confirmation via email. Full payment is required 14 days before the scheduled program start date.

3.2 Pricing

All prices are quoted in Malaysian Ringgit (MYR) and include transport from Kota Kinabalu, accommodation, meals, guided activities, and conservation area permits. Prices do not include travel insurance, personal expenses, or alcoholic beverages unless explicitly stated.

3.3 Payment Methods

We accept bank transfers and major credit cards processed through secure third-party payment processors. Payment confirmation will be sent within 48 hours of receipt.

4. Cancellation and Refunds

4.1 Cancellation by Guest

  • More than 30 days before departure: 75% refund of total payment
  • 15-30 days before departure: 50% refund of total payment
  • Less than 15 days before departure: No refund

Cancellations must be submitted in writing via email to [email protected]. Refunds will be processed within 14 business days.

4.2 Cancellation by Monsuniq

We reserve the right to cancel programs due to insufficient bookings, extreme weather, safety concerns, or force majeure events. In such cases, you will receive a full refund or the option to reschedule to alternative dates.

5. Participant Requirements

5.1 Age and Fitness

Participants must be 18 years or older, or accompanied by a parent or guardian. Our programs involve moderate physical activity including forest walks on uneven terrain. You must disclose any medical conditions that may affect your participation.

5.2 Documentation

You must provide valid identification (passport or IC) for permit processing. International visitors must hold valid passports and appropriate Malaysian visas if required.

5.3 Insurance

All guests must maintain valid travel and medical insurance covering rainforest activities and medical evacuation. We are not liable for costs arising from medical emergencies.

6. Conduct and Responsibilities

6.1 Guest Conduct

You agree to:

  • Follow guide instructions and safety protocols at all times
  • Respect wildlife observation guidelines and maintain safe distances
  • Refrain from littering, feeding wildlife, or damaging vegetation
  • Comply with conservation area regulations
  • Respect other guests and local communities

6.2 Prohibited Activities

The following activities are strictly prohibited:

  • Possession or use of illegal substances
  • Removal of plants, animals, or natural materials from conservation areas
  • Use of drones without prior written authorization
  • Loud noise or behavior that disturbs wildlife

6.3 Termination of Services

We reserve the right to terminate your participation without refund if you engage in conduct that endangers yourself, other guests, staff, or wildlife, or if you violate conservation area regulations.

7. Liability and Disclaimers

7.1 Assumption of Risk

You acknowledge that rainforest activities involve inherent risks including encounters with wildlife, insects, challenging terrain, tropical weather, and remote locations with limited medical facilities. You voluntarily assume these risks.

7.2 Limitation of Liability

Monsuniq is not liable for injury, illness, loss of property, or death resulting from circumstances beyond our control, including natural disasters, wildlife encounters, weather events, or your failure to follow safety instructions. Our liability is limited to the amount you paid for services.

7.3 Force Majeure

We are not liable for failure to perform services due to circumstances beyond our control, including natural disasters, government actions, civil unrest, or health emergencies.

8. Intellectual Property

All content on our website, including text, photographs, logos, and design elements, is owned by Monsuniq or licensed to us. You may not reproduce, distribute, or use this content without written permission. You retain ownership of personal photographs taken during programs but grant us permission to use them for promotional purposes unless you opt out in writing.

9. Privacy

Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.

10. Changes to Services

We reserve the right to modify program itineraries due to weather, safety concerns, wildlife activity patterns, or other operational factors. We will make reasonable efforts to provide equivalent alternative activities. Such modifications do not constitute grounds for cancellation with refund.

11. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Sabah, Malaysia. Before pursuing legal action, parties agree to attempt informal resolution through direct communication.

12. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Changes to Terms

We may update these Terms and Conditions periodically. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified terms. Bookings made before changes take effect remain subject to the terms in place at the time of booking.
